Anyone who retains a lawyer in Turkey should contract with them for the specific services they wish them to perform together with fees and special instructions. All instructions to the lawyer should be made in writing to avoid confusion as even with a written contract a lawyer is not necessarily bound to their client’s instruction (although they are legally bound to serve their best interests).
Fees are subject to little regulation and have no upper limit. They are determined by the lawyer but you can bargain. The fee will depend on variable factors which include the lawyer’s reputation, experience, knowledge, specialisation, and (especially important to non-Turks) foreign language abilities. The client’s nationality and how much similar litigation might cost in their home country are also taken in account
The lawyer’s fee is guaranteed and must be paid even if they are dismissed during a transaction as withholding an attorney’s retainer or other fees is grounds for legal prosecution.
For a fee individuals may lodge written complaints about lawyers with the Bar Association who review complaints and forwards those meriting investigation to a disciplinary committee.
